Last updated 2026-10-26. These terms apply to every quote we issue and every order we fill, whether placed through this website, by phone, by text or at our will call counter. By placing an order you agree to them. If you have a signed account agreement with us, that agreement controls where it differs from these terms.
Quotes and pricing
Quotes are valid for 30 days unless the quote says otherwise. Prices are wholesale, by the case or pallet, and exclude sales tax, delivery fees and any deposits unless stated. Because paper, resin and freight costs move, we may update pricing on items not yet ordered; we will tell you before we fill an order at a price different from your quote. Obvious errors in a quote or invoice may be corrected.
Orders and payment
Orders are accepted when we confirm them. New customers pay at or before delivery or pickup unless credit terms have been approved in writing. Approved accounts are invoiced and payment is due according to the terms on the invoice. Past due balances may accrue a late charge as permitted by California law, and we may hold shipments on past due accounts.
Delivery and will call
Route delivery is available in our service area on scheduled days; delivery minimums and any delivery fee are stated on your quote or confirmed when you order. Please inspect deliveries when they arrive and note any shortage or damage on the delivery ticket. Will call pickup is available at 1590 Little Orchard St, San Jose, CA 95110 during posted hours. Will call orders not picked up within 7 days may be returned to stock.
Returns
Unopened, undamaged cases of regularly stocked items may be returned within 7 days of delivery or pickup for credit, less any restocking charge noted on your invoice. Special order items, opened cases, chemicals and food contact items that have left our control are not returnable except for defects. Custom printed products are made to order and are not returnable except for printing defects or deviation from the approved proof.
Custom printing
You are responsible for the accuracy of artwork you approve and for having the right to use any logo or trademark you send us. Production begins only after you approve a digital proof. Printed quantities may vary from the ordered quantity by a small industry standard overrun or underrun and are billed as shipped. Lead times are estimates.
Product information and compliance
We describe products as accurately as we can and pass along manufacturer certifications when available. Foodware regulations vary by city and county and change over time; you are responsible for confirming that the products you order comply with the rules at your location. Product images on this site are representative; sizes, colors and packaging may vary by manufacturer lot.
Warranty and liability
Products carry the manufacturer's warranty, if any. Except as required by law, we make no other warranties, express or implied, including merchantability or fitness for a particular purpose. Our liability for any order is limited to the price you paid for the affected goods. We are not liable for indirect, incidental or consequential damages, including lost profits.

Governing law
These terms are governed by the laws of the State of California. Any dispute will be resolved in the state or federal courts located in Santa Clara County, California.
